Pursuant to section 223 of the Local Government Act 1993, the role of Parkes Shire Council's governing body is:

·         To direct and control the affairs of Parkes Shire Council in accordance with the Local Government Act 1993, in consultation with the General Manager.

·         To provide effective civic leadership to the local community.

·         To ensure as far as practicable the financial sustainability of the Council.

·         To ensure as far as practicable that the Council acts in accordance with the principles set out in Chapter 3 of the Local Government Act 1993 and other strategic plans, programs, strategies and policies of the Council.

·         To determine and adopt a rating and revenue policy and Operational Plans that support the optimal allocation of the Council’s resources to implement the strategic plans (including the Community Strategic Plan) of the Council and for the benefit of the local area.

·         To keep under review the performance of the Council, including service delivery.

·         To make decisions necessary for the proper exercise of the Council’s regulatory functions.

·         To determine the process for appointment of the General Manager by the Council and to monitor the General Manager’s performance.

·         To determine the senior staff positions within the organisation structure of the Council, following consultation with the General Manager.

·         To consult regularly with community organisations and other key stakeholders and keep them informed of the Council’s decisions and activities.

·         To be responsible for ensuring that the Council acts honestly, efficiently and appropriately.

Matters determined by meetings of Parkes Shire Council's governing body will include all those non-delegable functions identified in section 377 of the Local Government Act 1993.

Guiding Principles

In accordance with section 8A of the Local Government Act 1993, Councillors are reminded of the guiding principles applicable to decision-making by local councils:

·         Councils should recognise diverse local community needs and interests.

·         Councils should consider social justice principles.

·         Councils should consider the long-term and cumulative effects of actions on future generations.

·         Councils should consider the principles of ecologically sustainable development.

·         Council decision-making should be transparent and decision-makers are to be accountable for decisions and omissions.

 

Statement of Ethical Obligations

In accordance with clause 3.22 of Council's Code of Meeting Practice, Councillors are reminded of their Oath or Affirmation of Office made under section 233A of the Act and their obligations under Council's Code of Conduct to disclose and appropriately manage conflicts of interest.

 

Oath or Affirmation of Office

The Oath or Affirmation is taken by each Councillor whereby they swear or declare to undertake the duties of the office of Councillor in the best interests of the people of the Parkes Shire and Parkes Shire Council and that they will faithfully and impartially carry out the functions, powers, authorities and discretions vested in them under the Local Government Act 1993 or any other Act to the best of their ability and judgment.

 

Conflicts of Interest

All Councillors must declare and manage any conflicts of interest they may have in matters being considered at Council meetings in accordance with the Council’s Code of Conduct.  All declarations of conflicts of interest and how the conflict of interest was managed will be recorded in the minutes of the meeting at which the declaration was made.

Councillors attending a meeting by audio-visual link must declare and manage any conflicts of interest they may have in matters being considered at the meeting in accordance with Council’s Code of Conduct.  Where a Councillor has declared a pecuniary or significant non-pecuniary conflict of interest in a matter being discussed at the meeting, the Councillor’s audio-visual link to the meeting will be suspended or terminated for the time during which the matter is being considered or discussed by Council, or at any time during which Council is voting on the matter.

Councillors should ensure that they are familiar with Parts 4 and 5 of Council's Code of Conduct in relation to their obligations to declare and manage conflicts of interests.

1            Opening of Meeting

In the spirit of open, accessible and transparent government, meetings of Parkes Shire Council are video recorded and webcast, consistent with Council's Code of Meeting Practice and the Local Government Act 1993.

Council accepts no liability for any defamatory, discriminatory or offensive remarks or gestures made during the course of meetings.  Opinions expressed or statements made by individual participants are the opinions or statements of those individuals, and do not imply any form of endorsement by Council.

Closed sessions of Council meetings are not video recorded or webcast.

Recordings and webcasts are protected by copyright and owned by Council, and published to Council's website.  No part may be copied, recorded, reproduced or transmitted without the prior written consent of the General Manager.  Any recording or webcast is not, and shall not, be taken to be an official record of Council or discussion depicted therein.  Only the official minutes may be relied upon as an official record of the meeting.

Authorised media representatives are permitted to record meetings provided written notice has been lodged.  A person may be expelled from a meeting for recording without notice.  Recordings may only be used for the purpose of accuracy of reporting and are not for broadcast, or to be shared publicly.  No recordings of any private third-party conversations or comments of anyone within the Chamber are permitted.

2            Acknowledgement of Country

The Mayor will invite a Councillor to deliver an Acknowledgement of Country:

       Parkes Shire Council acknowledges the Wiradjuri People who are the Traditional Custodians of the Land. I would also like to pay respect to the Elders past, present and emerging of the Wiradjuri Nation and extend that respect to other Aboriginal peoples from other nations who are present.

Alternatively, the Councillor may deliver the following Acknowledgement of Country in Wiradjuri language, which has been provided by Mr Geoff Anderson, a Wiradjuri Elder resident of the Parkes Shire:

In accordance with clauses 5.3, 5.4 and 5.5 of Council's Code of Meeting Practice, apologies must be received and accepted from absent Councillors and a leave of absence from the Council Meeting may be granted.

 

5            Applications to Attend by Audio-Visual Link

In accordance with clauses 5.18 and 5.19 of Council's Code of Meeting Practice, Councillors may attend and participate in meetings by audio-visual link with the approval of the Council.

Requests by Councillors for approval to attend a meeting by audio-visual link must be made in writing to the General Manager prior to the meeting in question and provide reasons why the Councillor will be presented from attending the meeting in person.

Councillors attending a meeting by audio-visual link are reminded that they must ensure that no other person is within sight or hearing of the meeting at any time that the meeting is closed to the public under section 10A of the Local Government Act 1993.

Note: Consistent with clause 5.43 of Council's Code of Meeting Practice, attendance by Council staff at meetings of the Council by audio-visual link shall be with the approval of the General Manager.

1            Opening of Meeting

The Mayor declared the Ordinary Council Meeting of Tuesday 27 June 2023 open and welcomed Councillors, Council Officers and members of the public attending and listening to the meeting.

The Mayor advised attendees that the meeting was being recorded and streamed live on the internet, to enhance the accessibility of Council meetings to the broader Parkes Shire community, and that the recording will be archived and made available on Council’s website.

The Mayor asked that attendees ensure that mobile phones and other electronic devices were turned off or in silent mode for the duration of the meeting.

The Mayor further advised that all care would be taken to maintain privacy, however, as a visitor in the public gallery, members of the public should be aware that their presence may be recorded.

 

2            Acknowledgement of Country 

Cr Westcott read the following Acknowledgement of Country:

Parkes Shire Council acknowledges the Traditional Custodians of the Wiradjuri Country and recognises and respects their cultural heritage, beliefs and continuing connection with the lands and rivers of the Parkes Shire.

Council pays its respects to Elders past, present and emerging and extends this respect to all First Nations peoples in the Parkes Shire.

3.       Agree to adopt the Parkes Health Precinct Masterplan as amended by above.

16.1       Rental Assistance - 86 Derribong Street Peak Hill

This matter is considered to be confidential under Section 10A(2) - a of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with personnel matters concerning particular individuals (other than councillors).

Further it is considered that discussions of this matter in open Council would, on balance, be contrary to the public interest as it would prejudice Council's ability to secure the optimum outcome for the community.

16.2       Parkes Cemetery Extension- Section J

This matter is considered to be confidential under Section 10A(2) - d(i) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with commercial information of a confidential nature that would, if disclosed prejudice the commercial position of the person who supplied it.

Further it is considered that discussions of this matter in open Council would, on balance, be contrary to the public interest as it would prejudice Council's ability to secure the optimum outcome for the community.

2.       Exclude the media and public from the meeting on the basis that the business to be considered is classified as confidential, pursuant to 10A(1), 10(2) and 10A(3) of the Local Government Act 1993.

3.       Withhold reports and correspondence relevant to the subject business be withheld from the media and public as provided by section 11(2) of the Local Government Act 1993.

4.       Make public resolutions made by the Council in Closed Session after the conclusion of the Closed Session, and record such resolutions in the minutes of the Council meeting.

7            Disclosures of Interests

In accordance with Part 16 of Council's Code of Meeting Practice, all Councillors must disclose and manage any conflicts of interest they may have in matters being considered at the meeting.

Council's Code of Conduct deals with pecuniary and non-pecuniary conflicts of interest and political donations, and provides guidance on how these issues should be managed.

Councillors, and where applicable, other Council Officials, must be familiar with Council's Code of Conduct and their obligations to disclose and manage any conflicts of interest that they may have in matters being considered at this Council Meeting.

Note: Councillors and staff who declare an Interest at the Council Meeting are also required to complete a Declaration of Interest form.

Pecuniary Interests

A Councillor who has a pecuniary interest in any matter with which the Council is concerned, and who is present at a meeting of the Council at which the matter is being considered, must disclose the nature of the interest to the meeting.

Less than Significant Non-Pecuniary Interests

A Councillor who determines that they have a non-pecuniary conflict of interest in a matter that is not significant and does not require further action, when disclosing the interest must also explain why conflict of interest is not significant and does not require further action in the circumstances.

We had the pleasure of hosting the Hon. Rose Jackson MLC, Minister for Water, Housing, Homelessness, Mental Health, Youth and North Coast on Monday 26 June 2023. 

The Minister was in attendance to welcome delegates of the Local Government NSW Water Conference being hosted by Parkes from 26 - 28 June and to announce the funding for the Parkes - Peak Hill Water project currently underway (Media Release attached Annexure A).

In the afternoon the Mayors and General Managers of CNSWJO Councils also took the opportunity to meet with the Minister at the Parkes Shire Council offices to discuss various regional water issues, including the Wyangala Dam wall raising project and the Central West Council Water Utilities Alliance Grid for future drought proofing.

We then had the opportunity to outline what Parkes Shire Council has been doing in the water space.  The Minister confirmed the State Government's contribution of $22 Million for the water pipeline project from the Safe and Secure Water Grants program.  The Minister also indicated that this current round of $1 Billion is fully committed but there would be a new round of funding announced in due course.

The Minister took the opportunity to visit our new water treatment plant and see the wonderful views of Parkes from the new Reservoir.  That evening she impressed delegates to the Water Conference in her welcome address.

Report

The Director of Operations and I attended the 2023 IPWEA NSW Local Roads Congress held in Sydney, New South Wales on 5 June 2023. The Congress, conducted by the Institute of Public Works Engineering Australia, continues to be a very important annual event for local government.

The NSW Roads Congress has been held over several years and has been instrumental in the continuation of many major funding programs available to Councils. Parkes Shire Council has been represented at, and contributed to, all previous NSW Roads Congress events by Councillors together with a senior staff member.

The first NSW Local Roads Congress was held in 2005 and has been held annually since. Councils have recognised the importance of maintaining a united voice with 80-120 delegates attending each year.  The purpose of the Congress us intended to address policy issues rather than technical issues and to optimise roads and transport outcomes.

Through the continued attendance of the Congress by Local Government representatives across NSW, considerable influence has been exerted on the State Government to assist Councils with the significant backlog of works on road and transport infrastructure.

The 2023 Congress was pleased to host over 100 senior council staff, councillors and ministers who were present at this year’s event, under the theme of ‘Sustainable Investment’.

The IPWEA NSW Local Roads Congress welcomed Ministers John Graham and Jenny Aitchison, and Shadow Ministers Natalie Ward and Sam Farraway for their keynote addresses, as well as their respectful and cooperative discussions during the ministerial panel discussion. Along with the relevant Ministers, there were also presentations from five technical experts for their presentations and engagement through the technical panel discussion.

The need for resilience and betterment of the local road network was one of the common themes to emerge from the congress

Report

The recipients for the Parkes Shire Council 2023 Cultural Grants were presented their grant funding on 4 July 2023 at the Parkes Shire Council Chambers. Mayor Ken Keith and Councillor Marg Applebee officiated the presentation.

The annual grants program aims to increase cultural activity in the community, encourage innovative creative events and workshops, help artists, crafters, musicians develop their skills and to provide funds maintain or develop facilities.

The grants totalling $10,000 were awarded to the following local groups:

·    Parkes Community Arts Inc will use the grant to plan and deliver a community photography project and exhibition titled Who is Parkes? in December as part of the 150th anniversary of the naming of Parkes.

·    Parkes School of Dance will use the cultural grant to host Ready to Rock 'n' Roll Dance Workshops with the Sydney Swing Katz in preparation for the 2024 Parkes ELVIS Festival.

·    Parkes Christian School will use their grant to use artwork designed by students to create painted murals at the school.

·    Trundle Bush Tucker Day will use their grant to support the cultural entertainment at this year's Trundle Bush Tucker Day.

Mayor Ken Keith commented on the difficult task of selecting the successful projects given the high calibre of applications received.

"Parkes Shire Council is proud to support cultural activities and events that add to the richness and vibrancy of our Shire, and we are looking forward to seeing these projects and events take place." said Mayor Keith.

Cr Applebee also commended all seven of the applicants for the exceptional quality of their applications and projects put forward, demonstrating the diversity and talent in the Parkes Shire.


 

Natalie Williams from the Parkes School of Dance thanked the Parkes Shire Council for the opportunity. "We are so excited to be able to bring Sydney Swing Katz here to share their love of dancing with everyone in Parkes." said Natalie. "It will be a real opportunity for community members of all ages and experiences, to practice some dance moves to prepare for the Parkes Elvis Festival. The workshops will take place later this year so keep an eye out on the Council's website and for publicity around town."

Parkes Community Arts Chairperson, Margot Jolly also thanked the Council for their ongoing support of the arts community of Parkes and said Parkes Community Arts is looking forward to letting the community know in the next couple of months how they can get involved in the Who Is Parkes? project.

The Mayor declared the Extraordinary Council Meeting of Wednesday 12 July 2023 open and welcomed Councillors, Council Officers and members of the public attending and listening to the meeting.

The Mayor advised attendees that the meeting was being recorded and streamed live on the internet, to enhance the accessibility of Council meetings to the broader Parkes Shire community, and that the recording will be archived and made available on Council’s website.

The Mayor asked that attendees ensure that mobile phones and other electronic devices were turned off or in silent mode for the duration of the meeting.

The Mayor further advised that all care would be taken to maintain privacy, however, as a visitor in the public gallery, members of the public should be aware that their presence may be recorded.

Background

In accordance with clause 212 of the Local Government (General) Regulation 2021 (“the Regulations”), the Responsible Accounting Officer must provide Parkes Shire Council ("Council") with a monthly written report setting out details of Council’s investments under section 625 of the Local Government Act 1993 (“the Act”).  The report must also include certification that these investments have been made in accordance with the Act, the Regulations and Council’s Investment Policy.

ISSUES AND COMMENTARY

The balance of Council’s investments as of 30 June 2023 stands at $41,843,922 and the principal outstanding on council's borrowings at $17,482,157. Council's investments decreased by $3.14 million during June with cash outflows associated with on-going flood recovery works across the transport network and the financial year-end payments for capital and operational expenses.

Council's investments increased with $5.1 million during the financial year. This increase was mainly due to the pre-payment of the Financial Assistant Grants (FAGs), an increase in investment revenue, the recovery of legal fees and a cash profit in the sewer fund. There were a number of other variances compared to last year like the storm events, the reduction in water usage, road works and capital projects which cancels out one another.

On 30 June 2023, Council's investment portfolio was yielding 4.39 per cent per annum. Council's investments cover externally restricted cash reserves and internal restricted cash reserves.


 

The following charts depict a summary of the investments held by Council based on the individual institutional exposure and credit rating of the institutions with which they are held.

 

Legislative and Policy Context

Council's investments are held in accordance with Council's Investment Policy which accords with the requirements of the:

·    Local Government Act 1993 ("the Act") - Section 625

·    Local Government Act 1993 ­- Order (of Minister) dated 16 November 2020

·    The Trustee Amendment (Discretionary Investments) Act 1997 ­- Sections 14A(2), 14C(1) and (2); and

·    Local Government (General) Regulation 2021 ("the Regulation") - Clauses 212 and 215.

Financial Implications

All returns on investments are included in Council's Operating Budget. Any amendment to budgeted interest income is affected through the Quarterly Budget Review process. Both the average level of funds invested, and the rate of return determine returns.

In accordance with the Australian equivalent of International Accounting Standards, securities that are classified as held for trading are required to be valued at market value at each balance date. Investments in the form of cash or cash equivalents and held to maturity investments are valued at cost. Floating Rate Notes acquired on the secondary market are valued at cost. Where the purchase consideration is different to face value, the resulting premium or discount are amortised on a straight-line basis over the life of the Note.

Risk Implications

Council's investments are managed in accordance with Council's Investment Policy.

There are no community consultation requirements for Council associated with this report.


 

Conclusion

The Chief Financial Officer has certified that the investments listed in the Investment Summary have been made in accordance with section 625 of the Act, clause 212 of the Regulation and Council's Investment Policy. Council's investments continue to focus on capital protection, as well as compliance with the Investment Policy, whilst actively seeking the best return allowable within these parameters. It is recommended that Council receive and note the Statement of Investments and Borrowings as on 30 June 2023.

Background

Parkes Shire Council hosted the 2023 Local Government NSW Water Conference from 26 to 28 June 2023. 

ISSUES AND COMMENTARY

"I am delighted to report on the highly successful completion of the Local Government Water Conference (LGNSW) held from Monday, 26 June to Wednesday, 28 June. This conference was a momentous occasion, bringing together over 250 attendees from various sectors to exchange knowledge and insights on the latest advancements and best practises in water governance and management.

The event kicked off for a remarkable welcome dinner featured at the Hart Bar, a delightful venue that provided an ideal setting for networking. The evening commenced with a warm welcome from the Mayor of Parkes Shire Council, setting the tone for the exciting days ahead. The welcome dinner featured live entertainment from local artist ' Brianna Cotterill', and delectable cocktails and tapas to further enhanced the festive atmosphere.

The conference began with a warm welcome from esteemed speakers, including MC Geoff Bailey, Geoff Anderson from the Parkes Wiradjuri Group, and Cr Ken Keith OAM, the Mayor of Parkes Shire Council. Additionally, conference attendees were honoured to have virtual addresses from The Hon Tanya Plibersek MP, Federal Member the Environment and Water, and The Hon Rose Jackson MLC, State Minister for Water, who shared their invaluable perspective on water management.

The Conference featured over 40 speakers, each offering expertise from different areas of the water sector. A thought-provoking panel discussion on the challenges of providing quality water supply to rural and remote communities, with distinguished panellists from the Department of Planning an Environment, NSW Health Water Unit, Water Services Association of Australia, and Goldenfields Water.

Delegates had the opportunity to participate in three concurrent conference streams focusing on infrastructure, innovation and technology, and resilience and recovery from drought, fire, and floods. Each stream offered engaging presentations and discussion on topics such as strategic recommendations for infrastructure development, maintaining water and sewer services during major floods.

A highlight of the conference was the site visits organised by Parkes Shire Council, where delegates had the privilege of experiencing state-of-the-art water infrastructure in our Shire. The visits included tours of the Water Treatment Plant, Wastewater Treatment Plant, Recycled Water Treatment Plant and Akuna Road Wetlands."

Along with the Mayor, Parkes Shire Deputy Mayor Neil Westcott and Councillors Bill Jayet and Marg Applebee attended the Conference.

Council staff assisted LGNSW with the organising of the Conference with the following comments received by Council's Executive Manager Economy, Destination and Activation Carrie Olsen from the LGNSW Events Officer.

Megan Morrison was lovely to work with for the duration. All the team, Lisa Moon, Hannah Jayet, Michael Chambers, Sharon Klarner, Jenny Kingham, Rebecca Scully, Georgia Wood and Jill Petersen at the Conference itself were great. Megan had briefed them on all information as well which was evident and very helpful.

Andrew Francis is a wealth of knowledge and is such an expert in everything water.

I must also acknowledge Graeme Baylis and his team who were extremely knowledgeable and accommodating in all the site visits attended by the conference delegates.

12.1       Request for Financial Assistance - 2023 Trundle Bush Tucker Day

Recommendation

That Council:

1.       Receive and note the correspondence from the Trundle Bush Tucker Day Committee, appended at Annexure A

2.       Provide public notice of its intention to provide $6,000 in financial assistance and in-kind support to the Trundle Bush Tucker Day Committee, as detailed in this report, to support the delivery of the Trundle Bush Tucker Day in September 2023.

3.       Pursuant to section 356 of the Local Government Act 1993, approve the provision of $6,000 to the Trundle Bush Tucker Day Committee, subject to no submissions being received.

4.       Consult with the Trundle Progress Association (Trundle CCC) on whether they will support the provision of additional funds from the Trundle Town Improvement Fund, and if so, include that amount with the public notification process as outlined in recommendations 2 and 3 above.

 

Background

The Trundle Bush Tucker Day is an important event for the Trundle Community. The popular food and entertainment festival started 37 years ago as a bet between two mates to see who could cook the best tucker in a camp oven behind the Trundle Hotel. The Trundle Bush Tucker Day attracts hundreds of people and offers a great day of family fun.

The Trundle Bush Tucker Day Committee ("the Committee") is a not-for-profit group made up of volunteer members. Each year the Committee donates all profits back to 16 Trundle community groups who rely on these funds to support their activities. The Committee has written to Parkes Shire Council ("the Council") to seek financial assistance to stage their 2023 event, which will be held on Saturday 2 September. Council and the Trundle Progress Association have previously financially supported the Committee in the staging of their events.

ISSUES AND COMMENTARY

The Trundle Bush Tucker Committee are proposing to host the 37th Trundle Bush Tucker Day on Saturday 2 September 2023. The event will be held at the Trundle Showground and is expected to attract more than 2,000 guests for a day of family friendly bush events. These include live entertainment from country music legend Brad Cox, rides, sheep shearing demonstrations, billy boiling, relays, dog jumping, bush cooking competitions and free children's corner activities. The Trundle Bush Tucker Committee have invited the Mayor and Councillors to attend the Trundle Bush Tucker Day if they are available.

The event has grown over the years and so have the costs required to stage it. In its letter, included as Annexure A, the Committee has requested support for five additional items for this year's event. Treasurer Stacey Edwards states:

"With the ongoing struggle to seek volunteer committee members please understand this year will be a challenging event to pull off physically and financially, after the profits and deposits lost in previous years due to flooding and Covid19."

In exchange for the provision of any financial and in-kind support, Council will require appropriate sponsorship recognition and acknowledgement from the Trundle Bush Tucker Committee via social media platforms, logo inclusion on all marketing collateral and website and the use of Council tear drop banners at the event.

Legislative and Policy Context

Council can only approve financial assistance (cash or in-kind) in accordance with section 356 of the Local Government Act 1993 ("the Act"). If the proposed financial assistance was not included in Council's adopted Operational Plan for the year, the proposed financial assistance must be publicly exhibited by Council prior to it being provided. Council must consider any public submissions received, prior to providing the assistance requested.

Staff are mindful that there needs to be a policy and budget in place to support recurring events, such as this, so that there would no longer be a need to bring the request to Council under Section 256 of the Act. Staff reports to Council would only be required where there are unusual circumstances regarding the request, such as a request for additional funds.

Financial Implications

The amount of financial assistance Council has previously provided for this event is around $6,000.00 from the Community Events budget, for the following items:

·    25 x event bins, including drop off and collection, estimated to cost $500.

·    In-kind provision of Covid safe equipment such as hand sanitiser stations.

·    In-kind provision of administration costs such as printing, posters, signage, colouring in materials for children, estimated to be $300.

·    Professional photography, estimated to cost $500.

·    20 x portable toilets including delivery and dismantle, pick up, pump out (if required) and collection, estimated to be $3,500.

·    Two (2) gift hampers for the competition prizes, estimated to cost $200.

·    One marquee for the kids' corner (in-kind).

·    In-kind marketing and promotional support from Council's Visitor Economy and Events team.


 

Additional funding has been requested by the Committee for the 2023 event, to the value of $12,330.00, for the following items:

·    Event medic, estimated to cost $550.

·    300 x kids entertainment packs, estimated to cost $3,600.

·    Fencing, estimated to cost $2,880.

·    Security, estimated to cost $4,300.

·    Portable lighting, estimated to cost $1,000.

 

Instead of providing the additional amount requested from the Community Events budget, Council could consult with the Trundle Progress Association on whether they would support the provision of any additional funds from the Trundle Town Improvement Fund ("TIF"). The Progress Association has supported the provision security fencing for the previous event from the Trundle TIF.

Risk Implications

There is a positive civic risk opportunity to support the Committee in its fund-raising efforts on behalf of the Trundle community groups that benefit from the distribution of profits from the event, provided that the Committee acknowledges that support in its advertising and promotion.

However, should Council decide to provide the full amount requested from the Community Events budget, then there is a negative civic risk that Council will be unable to support other community events as there would be less budget available.

Community Consultation

The proposed financial assistance must be publicly exhibited prior to being provided. Council must consider any public submissions received, prior to providing the assistance requested. The Trundle Progress Association must be consulted should Council wish to provide additional funds to the Committee from the Trundle Town Improvement fund instead of the Community Events budget.

Conclusion

Council has the option to provide the usual value of $6,000.00 to the Committee to support the 2023 Trundle Bush Tucker Day subject to the provisions of section 356 of the Act. Council may choose to provide an additional $12,000, which brings the total value of cash and in-kind support to $18,000.00. However, if the additional support is provided, the overall pool of funds available for support of other community events for the rest of the financial year is reduced.  Alternatively, the Trundle Progress Association could be consulted on whether it will support a contribution from the Trundle TIF.

This report recommends that Council provide financial assistance to the amount of $6,000.00, subject to the provisions of section 356 of the Act and that Council consult with the Trundle Progress Association on whether they would support the provision of additional funds from the Trundle TIF.

Background

The Parkes Australia Day Committee and township Committees have organised the annual celebrations of Australia Day for many years. In the past Council has assisted the Committees by contributing annual budgeted monies to stage celebratory events throughout the Shire. The Committees also receive administrative assistance with the implementation of the Australia Day Awards.

The Parkes Shire Australia Day Committee have written to Council to advise of changes to the nomination process, a new award, and a draft plan for the 2024 Parkes Shire Australia Day Celebrations.

ISSUES AND COMMENTARY

Nominations

The nomination process has been expanded to start earlier in the year.  Nomination forms will be available on paper (available at Parkes Shire Administration Reception, Parkes Shire Library and Henry Parkes Centre), in downloadable PDF format and online mode through the Council Website.  Completed forms can be submitted online through the form, via email or on paper in a locked box at Parkes Shire Administration Reception.  All completed nominations will be directed to the Executive Secretary for collation and storage in Council’s ECM system with a confidential classification to ensure one point of secure contact.

New Community Award for Lifetime Achievement 

The Committee has created a new Community award for 2024 to recognize Lifetime Achievement, as there are many in Parkes worthy of such an award, and to allow the Citizen of the Year award to recognize current achievements rather than just lifetime achievements.

To this effect, we wish to ask for Parkes Shire Council to organize an Honour Board to record these awardees, as is in place for the Citizen and Young Citizen of the Year.  There will be two Lifetime Achievement Awards given each year.


 

Draft Plan for 2024 Parkes Shire Australia Day Celebrations

Two Ambassadors - The Committee has agreed to apply for two Australia Day Ambassadors for 2024 in recognition of the large amount of travel involved in covering both Parkes and villages events on Australia Day.  It is proposed that one Ambassador be assigned to Parkes and Peak Hill, and the other to Bogan Gate, Trundle and Tullamore.  This would allow for quality time to be spent at each location with each Ambassador able to participate fully in award presentations and events.

Parkes Australia Day Eve Event – The Committee proposes to hold a Citizenship Ceremony on Australia Day Eve at Cooke Park Pavilion, inviting friends and families of new citizens along.  The event will include possibly a BBQ/sausage sizzle or light supper and entertainment.

The Committee has been meeting during the year to facilitate these plans and look forward to Parkes Shire Council’s endorsement of the proposed changes.

Legislative and Policy Context

There are no legislative or policy considerations for Council associated with this report.

Financial Implications

Funds are allocated in each annual budget for Australia Day events. $500.00 is allocated to each of the Bogan Gate, Peak Hill, Trundle & Tullamore Townships whilst Parkes is included in the events budget.

The cost of a perpetual trophy at approximately $200.00 would be allocated from the Civic Fund.

Risk Implications

Community Consultation

Conclusion

Parkes Shire residents have enjoyed increasingly popular Australia Day activities in each of its five urban centres. Parkes remains one of the few Local Government areas in NSW with a heightened sense of community participation on this National Day of Celebration.

Recommendation

1.       Note the report from the Parkes Shire Town Crier on the 2023 National Town Crier Championships,

2.       Congratulate Mr Tim Keith on his participation in the competition, his results and on his reappointment as President of the Ancient and Honourable Guild of Australian Town Criers for a further 12 months.

 

 

Background

Council has actively supported its local Town Crier and the Ancient and Honourable Guild of Australian Town Criers by twice hosting the National Championships, which not only raised the profile of the Parkes Shire and our community but provided an economic bonus for businesses within the Shire.

At Council's meeting of 21 March 2023 Council resolved [OCM 046/23] to endorse the attendance of Parkes Shire Council's Town Crier Mr Tim Keith at the 2023 National Town Crier Championships in Marborough QLD from 29 June to 02 July 2023 inclusive.  Council also resolved to reimburse travel and accommodation costs incurred by Mr Keith upon presentation of receipts. These costs were estimated to be $1,075.00.

 

A civic gift for the Fraser Coast Regional Council Mayor George Seymour was also provided along with small Parkes Shire gift bags from the Tourism team for competition participants.

ISSUES AND COMMENTARY

Mr Tim Keith has provided the following report on the Championships.

Tuesday 27th June

Travelled Parkes to Goondiwindi to split the 1200km trip.

Wednesday 28th

Left Goondiwindi about 8am arriving at Maryborough at about 3pm, and chance to catch up with other Town Criers as we were all staying at the same motel.


 

Thursday 29th

Picked up from motel at 8am and taken to Maryborough city centre to join a parade with pipe band through city centre to promote the markets and also the Town Criers championships being held on Saturday and the Mary Poppins Festival on Sunday.

From there to the Town Hall for the Fraser Coast Mayoral Official welcome and exchange of gifts. The draw for the order of Cries for the competition on the Saturday was undertaken and I drew No 9 for the Home Cry and No 3 for the Host Cry, which I was happy with.

After reception we had a group photo on steps of Town Hall, and then a walk to Sussex St Railway station for an historic trip on Mary Ann Steam Train through a park and onto station and other end, about a 1km trip, and then the return trip. Back to the Town Hall for the firing of a cannon, which they do every Thursday.

After lunch a visit to Story Bank, which is the house PL Travers (author of Mary Poppins} lived in. The house has been beautifully restored and has everything Mary Poppins, as you would imagine. From there a short walk to Military and Colonial Museum and second only to the War Memorial in Canberra.

From there back to our motel about 4pm.Dinner was under the stars hosted by host crier Ken Ashford and his wife Judy, at their farm.

Friday 30th

A day in casual attire, first stop St Pauls Church Bell Tower, where we were given the history of tower and then we rang the bells (8 at a time) in correct order, of famous songs. We did "All my loving" by the Beatles. From there to Railway Museum for morning tea.

Onto Olds Engineering where we had a tour of their Engineering workshop where it was explained how they invented a new elevator for moving sand.

Back to the Town Hall for our Annual General Meeting where it was confirmed that I will continue as President for 1 more year.

Saturday 1st July Competition Day

Picked up from motel at 7-45am and taken to Queens Park where they have a Bandstand, from where we did our Cries. Town Criers did their Home Cry first, a cry about their  town and district. As mentioned earlier I had position 9, so had time to settle before my Cry. After morning tea we  did our Host Cry, with this year's theme being the Fraser Coast, where I had position 3. I was very happy with both my Cries, I think I got them both word perfect and did manage to slow myself down. So had to wait till presentation that night.

We were then taken back to motel and then picked up and taken to Gatakers Artspace a gallery where we had a tour, our dinner and the presentations to the Championship winners.

Sunday 2nd July

Bussed down to city centre at Queens Park where they were having the Mary Poppins Festival. Lots of stalls selling everything imaginable, and also entertainment on the Bandstand where we had done our Cries.

We mingled with the crowd letting them know what was going on. The official opening was at 9am, and after that we were divided into groups to help run Nanny and Chimney sweep races, Town Crier workshops, where we encouraged people to write and preform a Cry.

After lunch we again mingled with the crowd letting them know about the street parade at 2pm and then all the Town Criers participated as part of the parade.

At the conclusion of the parade, we were taken back to our motel and thus completed our participation at this year's Championships.

13.2       14 November 2022 Flood Hydrology Study

Recommendation

That Council:

1.       That Council authorise the extension of current hydrology work to include flood modelling of the Billabong Creek, Goobang Creek and various tributaries that catastrophically impacted the shire on 14 November 2022.

2.       That up to $100,000 be allocated for the modelling.

3.       That the modelling be funded from budget savings where possible otherwise from reserves.

 

 

Background

Council is aware than on the 14 November 2022 a large flood occurred down the Billabong Creek, Goobang Creek and various tributaries, causing the inundation of over 100 homes and causing catastrophic damage along the flood path.

The flood was significantly larger than any other in human memory.

Council has since been working closely with the Department of Planning Industry and Environment to procure funding ($80,000) to augment work currently underway on flood hydrology in the subject catchment. Unfortunately, we have recently been advised that the funding will now not be provided.

Without this preliminary flood hydrology work the flood event will be undefined in terms of magnitude and extent. This in turn is likely to cause uncertainty in the insurance sector and make planning decisions also difficult.

It should however be noted that a flood study that does identify possible inundation areas may also have adverse consequences for some residents.

ISSUES AND COMMENTARY

Because of the very significant number of dwellings affected, it is suggested that Council proceed with the additional flood hydrology work to the value of $80,000 to $100,000.

The work proposed will only provide basic information and further work will be needed. As a consequence further funds will be needed and grant applications will be accordingly lodged.

Legislative and Policy Context

Studies of this type are normally management through the Floodplain Management Grants program (FMGP). The FMGP has four (4) stages 1) the flood study 2) Floodplain risk management study 3) Investigation and design/feasibility study 4) Implementation.

The subject study should complete most of the work in phase one (1). Further study refinement and progression would need to be managed under the above program to be eligible for funding.

Financial Implications

Because of the very significant number of dwellings affected it is suggested that Council proceed with the additional flood hydrology work to the value of up to $100,000 as a budget over-run. Every effort will be made to make savings throughout the year to reduce the over-spend on this item. Any shortfall will be taken from reserves.

Risk Implications

The risk of not proceeding exposes the affected community to uncertainty, in terms of the past flood, future floods and insurance implications of both.

Community Consultation

The flood study was raised at a public meeting held on 13 December 2022. It was apparent that the community desired this work to be undertaken.

Conclusion

That Council should proceed to undertake basic flood modelling of the 14 November 2022 flood event down the Billabong Creek, Goobang Creek and various tributaries.

Council has approached the Owner of Lot 2 DP 513083, Oxley Street, Parkes to construct a new sewer to provide full site sewerage cover for the Currajong Disability Office situated at 32 Currajong Street, Parkes. The sewer is also to be extended further to replace an existing undersized sewer.

ISSUES AND COMMENTARY

The acquisition of the easement will require consultation with the owner, a survey, valuation report and negotiations for compensation.

Financial Implications

Funding to be available from Currajong Disability Sewer Relocation Project for $4,230.00.  Survey, valuation, legal costs and compensation at approximately $6,000.00.

Background

There are two (2) roads, off Henry Parkes Way, Yarrabandai and Havilah Lane Trundle that have been identified by Council to be owned by Crown.  They run adjacent to quarries that Council requires for access to obtain material for road upgrades and roadworks within the surrounding region.

There is also an Unnamed crown road off Massurit Lane, Parkes. Owners of Lot 3 DP 566429 requested to purchase from crown for access to their subdivision.  Crown advised that the owners ask Council to arrange a transfer from Crown to Council and then for Council to close the road and sell it to the owners of Lot 3 DP 566429. (Council Report for closure and sale of road to be completed at a later time)

ISSUES AND COMMENTARY

The transferring of the roads from Crown to Council will require an application form to be completed with no fees payable.

The transfer of the road from Crown to Council will assist with access to the quarries and access for the owners of Lot 3 DP 566429.

That Council:

Background

The Building Statistics Report is furnished to Council on a monthly basis and provides a snapshot of development activity in the Shire during that period.

ISSUES AND COMMENTARY

During the month of June 2023 there were thirteen (13) Development Applications received totalling $1,189,435.00 and nine (9) consents were issued. One (1) Council Certifier Complying Development Certificate totalling $69,300.00 was received.

The figures shown Table 1 below are for Development Applications received during June 2023 with respect to the specified building types and a comparison to the June 2022 figures.

Community Consultation

Where a Development Application or Modification Development Application is required to be publicly exhibited, the application was made available for inspection at the Parkes Shire Council Administration Centre commencing from the date on which the public notice was placed in the local newspaper. The application was also included on the Parkes Shire Council website.

For Development Applications requiring neighbour notification, written notification of the proposed development was provided to the owner(s) of land immediately adjoining or adjacent to the subject land (as shown on Council’s Property and Rating System at the time of notification) including land that is separated from the subject land by a watercourse, road, pathway, driveway, railway or similar thoroughfare.

Where more than one person is listed as the owner, written notification to one of the owners, is taken to be a notice to all of the registered owners.

Conclusion

15.3       State Library Assessment of Parkes Shire Library

Recommendation

That Council:

1.       Receives the Parkes Shire Library Assessment Report prepared by State Library NSW.

 

Background

Every three years Parkes Shire Library is reviewed against its peers to ensure the Library continues to adapt for the community and meets best practice standards and guidelines.

A comprehensive review of the Parkes Shire Library was undertaken in August 2018 against the Australian Library & Information Association Guidelines, Standards & Outcome Measures for Australian Public Libraries (July 2016). Due to events including the relocation of the library, COVID pandemic, and staff changes it had not been possible to undertake a comprehensive review of the library service that reflected regular service delivery.

Phillipa Scarf, a Public Libraries Services consultant from NSW State Library, undertook an assessment of the Parkes Shire library on 9 & 10 March 2023. This assessment was undertaken using the State Library's Living Learning Libraries: standards and guidelines for NSW public libraries document, analysis of the 2021/2022 Parkes Shire Library collection and usage data, and discussions during the assessment visit.

 

ISSUES AND COMMENTARY

Phillipa Scarf noted in the report that Parkes Shire Library is an excellent example of a collocated library with separate Makerspace and gallery and that Parkes Shire Council is to be commended for the significant investment in the facility. Below are excerpts from the report and a copy of the complete report is attached.

Performance against Living Learning Libraries Standards

The assessment revealed that the overall performance of the library service is in good shape with the following highlights:

·    The Parkes Shire Library strategic priorities for 2023/2024 is a well-considered plan for service delivery and community engagement

·    During the COVID-19 pandemic the Parkes Shire Library's overall performance remained within the cohort median

·    The library's performance against the benchmark report is in the middle 50% of the cohort

·    Library membership and visits per capita are above the cohort median

·    Library's expenditure on library materials is in the top 25% for the cohort and items per capita are slightly above the cohort median

Opportunities for improvement

In some areas the assessment identified areas for improvement against the standards. It was noted that data used was based on NSW public library statistics 2021/2022 and since this time a significant weeding (or deselection of materials) of the collection had taken place, new online collections purchased and significant effort had gone into the updating of the collection, which will positively impact upon the future results against the following standards:

·    Acquisitions per capita

·    Age of the collection

·    Turnover of stock

·    Circulation per capita.

Further recommended opportunities for improvement were identified in the assessment in relation to: furnishings and presentation of collection; suggestions for increasing circulation and promoting the collection/services; and ongoing professional learning opportunities for staff. The Manager Culture, Education & Library Services and Information & Library Services Team Leader have prioritised these recommendations and suggestions against the current strategic plan priorities and budget implications.

The subject land is in an urban residential area, zoned R1 General Residential. The site is located on the side of a hill and has downhill slope towards the south-eastern boundary (Jones Street frontage) of the allotment. The adjoining land is occupied by a dwelling-houses to the north and south, and west. The proposal is for the construction a of Multi-Dwelling Housing (2 dwellings, 6 townhouses) development, with detached dwelling-houses, dual occupancies, secondary dwellings and ancillary outbuildings being the predominant land uses in the residential area.

Council has previously issued development consent for a three-lot subdivision of the property which forms the lot layout for the proposed development.

 

Council has considered the proposed development considering relevant legislation and submissions and has assessed that the proposal, subject conditions, can be approved by Council.

COMMUNIY CONSULTATION

The proposed development was publicly advertised, and adjoining owners notified, between 4 May 2023 and 17 May 2023, in accordance with the Parkes Shire Community Participation Plan 2022. Council received three (3) submissions, all presenting objections to the proposed development, during the Public Exhibition period. Submissions are attached for reference

Conclusion

The applicant has provided further information regarding provision of a revised landscaping plan to address privacy and screening on the northern boundary, which is supported. This report includes appropriate Conditions of Development Consent which will require the applicant to comply with relevant building standards and address impacts such as the management of stormwater, vehicular movements, privacy and overlooking.

Following consideration of the submissions, Council staff have liaised with the objecting parties to discuss their submissions. After communication with the objecting parties, all submissions have been appropriately considered within the assessment process, with further conditions of consent recommended to address the issues raised. It is considered that the submissions received by Council during the exhibition period have been suitably addressed, and that the Development Application is recommended for approval.

16.1       Industrial Land Development

Councillor:              Cr Neil Westcott

Motion

That Council:

1.       Undertake a market sounding exercise by means of Expression of Interest (EOI) to determine the demand for industrial land, in the proposed South-Parkes industrial estate subdivision (i.e. the extension of Langlands & Hanlon Streets).

2.       That blocks be held based on a 10% holding deposit, only refundable if Council does not proceed.

3.       That the General Manager and Chief Financial Officer investigate the most appropriate funding model for the construction of the subdivision.

4.       That if there is sufficient interest a report be brought back to Council on how the subdivision may be delivered.

 

 

Background

The Parkes Special Activation precinct forecasts the creation of over 3000 jobs. When this comes to pass Parkes will see a significant population expansion, together with a commensurate expansion of retail, commercial and industrial activity.

Industrial land is least attractive in terms of yield (profit), and accordingly an area Council will need to be involved. During the recent successful auction of Councils only remaining available land parcel, there were numerous interested parties actively bidding on the parcel indicating that there may still be demand for suitably sized industrial blocks.

17          Confidential Matters

Recommendation

That Ordinary Council Meeting:

1.       Moves into Closed Session to deal with the matters below, which are classified as confidential under section 10A(2) of the Local Government Act 1993 for the reasons specified:

17.1       Purchase of Water

This matter is considered to be confidential under Section 10A(2) - d(i) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with commercial information of a confidential nature that would, if disclosed prejudice the commercial position of the person who supplied it.

Further it is considered that discussions of this matter in open Council would, on balance, be contrary to the public interest as it would prejudice Council's ability to secure the optimum outcome for the community.

17.2       Design and Construction of East Street Bridge (PSC2023/031)

This matter is considered to be confidential under Section 10A(2) - d(i) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with commercial information of a confidential nature that would, if disclosed prejudice the commercial position of the person who supplied it.

17.3       Plant and Procurement

This matter is considered to be confidential under Section 10A(2) - d(i) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with commercial information of a confidential nature that would, if disclosed prejudice the commercial position of the person who supplied it.

Further it is considered that discussions of this matter in open Council would, on balance, be contrary to the public interest as it would prejudice Council's ability to secure the optimum outcome for the community.

2.       Exclude the media and public from the meeting on the basis that the business to be considered is classified as confidential, pursuant to 10A(1), 10(2) and 10A(3) of the Local Government Act 1993.

3.       Withhold reports and correspondence relevant to the subject business be withheld from the media and public as provided by section 11(2) of the Local Government Act 1993.

4.       Make public resolutions made by the Council in Closed Session after the conclusion of the Closed Session, and record such resolutions in the minutes of the Council meeting.

 

Background, Issues and Commentary

In accordance with section 10A(2) of the Local Government Act 1993, Council may close part of its meeting to deal with business of the following kind:

(a)     Personnel matters concerning particular individuals (other than councillors).

(b)     Personal hardship of any resident or ratepayer.

(c)     Information that would, if disclosed, confer a commercial advantage on a person with whom Council is conducting (or proposes to conduct) business.

(d)     Commercial information of a confidential nature that would, if disclosed:

(i)      Prejudice the commercial position of a person who supplied it: or

(ii)     Confer a commercial advantage on a competitor of Council;

(iii)     Reveal a trade secret.

(e)     Information that would, if disclosed, prejudice the maintenance of law.

(f)      Matters affecting the security of Council, Councillors, Council staff and Council property.

(g)     Advice concerning litigation, or advice that would otherwise be privileged from production in legal proceedings on the grounds of legal professional privilege.

(h)     Information concerning the nature and location of a place or an item of Aboriginal significance on community land.

(i)      Alleged contraventions of any Code of Conduct requirements applicable under section 440.

It is my opinion that the business listed in the recommendation is of a kind referred to in section 10A(2) of the Local Government Act 1993 and, under the provisions of the Act and the Local Government (General) Regulation 2021, should be dealt with in a part of the meeting that is closed to members of the public and the media.

Pursuant to section 10A(4) of the Act and clauses 14.9–14.10 of Council's Code of Meeting Practice, members of the public may make representations to the meeting immediately after the motion to close part of the meeting is moved and seconded, as to whether that part of the meeting should be closed.

18          Report of Confidential Resolutions

In accordance with clauses 14.22 and 14.23 of Council's Code of Meeting Practice, resolutions passed during a meeting, or a part of a meeting that is closed to the public must be made public by the Chairperson as soon as practicable.
